When You Need an Engineering Expert Witness

An engineering expert is usually instructed when a construction or engineering dispute turns on technical questions: why a structure, facade or building system failed, whether design or workmanship met the required standard, what caused a delay, or what it will cost to put right. Experts give evidence in court proceedings, arbitration and adjudication, and are increasingly brought in early so that the parties understand the technical merits before costs escalate.

What Makes a Credible Engineering Expert

• Chartered status and hands-on experience in the discipline in dispute, ideally including design responsibility.
• Understanding of the expert’s duty. In England and Wales, CPR Part 35 makes clear that an expert’s duty to help the court overrides any obligation to the party instructing or paying them.
• Clear report writing and the ability to explain technical issues to judges, arbitrators and lawyers.
• Independence: no conflicts with the parties, the project or other experts involved.
• Training: many experts complete expert witness training, for example through the Academy of Experts or Bond Solon.

1. Brief: we agree the dispute type, discipline, forum, timetable and whether you need a testifying expert or a technical adviser.
2. Search: we approach chartered forensic and expert engineers in our network, including those not openly looking for instructions.
